I use to work at Game Stop. Nintendo has nothing to do with Gamestop doing a mid night release. That is a store by store decision with in Gamestop based on preorders. The store manager makes the decision.

XD yeah dude, this is all GameStop, not Nintendo. Whether or not they have a midnight release is up to the district manager who runs your area of GameStops, and they decide to give the green light or not by tallying up the pre-orders for the game, if there is enough pre-orders then they will do it. But even at that. Most small town GameStops never do Nintendo Midnight Releases unless it falls on a Tuesday with the rest of the weeks launches.

Preorders dictate having a midnight. Our DL won't let us have a midnight unless we have 85 or more preorders for a game. Nintendo is to blame for the no 9pm launch. They are super strict on 12am local time for their launches.
